Expert Legal Help for Those Injured by Defective DePuy Hip Implants
A DePuy recall has has issued by DePuy Orthopedics to all patients who received an ASR Acetabular Hip Implant from 2005 through 2010 due to increased reports that the mechanisms become loose, detached or dislocated, or the risk that the metal-on-metal socket can cause metal shavings to infect area tissue.
These implants were used in approximately 93,000 patients during this time and it is estimated that at least 13% of those will need additional surgery to remove and replace their implant. Others may experience extreme pain, discomfort, inflammation or trouble walking or standing.
If you have received a Recall Notice or Instructions from DePuy Orthopedics, DO NOT SIGN ANYTHING before speaking with an attorney about your legal rights.
The manufacturer of these hip implants is attempting to limit their exposure by encouraging patients to proceed with revision surgeries under their own health insurance or Medicare. They are also asking patients to sign medical releases and agreements to return the defective hip implants for testing. Do not agree to anything before speaking with an attorney.
Asking Medicare to pay for procedures that should be covered by third parties such as defective medical device manufacturers may violate the Medicare Secondary Payer Statute and subject the patient to additional costs. Also, signing a medical release or turning over a defective medical device may severely limit your potential to file a DePuy Lawsuit for damages.
Lawyers are currently filing DePuy Hip Implant Lawsuits for the damages suffered by those who have been affected by these defective medical devices.
If you or a loved one underwent surgery to implant a Depuy ASR Hip Replacement device and are experiencing any side effects, you may be entitled to significant monetary damages for your medical costs, loss of earnings and pain and suffering. Speak with an attorney to learn more about filing a claim. This DePuy recall applys to anyone who has had a hip replacement after 2005.
